Video Contest Official Rules

ELIGIBILITY:

In order to enter the Contest, you must (a) be a U.S. citizen or a legal U.S. resident (i.e. must be able to show proof of legal residence), (b) be enrolled in a private or public elementary or secondary school or a home school located within Tarrant County, Texas USA, at the time of entry, and (c) if a minor, have obtained a parent’s or legal guardian’s prior written permission.

With respect to participation by any minor, such minor shall have received written permission for his or her participation in this Contest from his or her parent and/or legal guardian(s) who shall be the designated agent for such minor under the Contest. For the purpose of these Official Rules, a parent or legal guardian of a minor shall be the Participant (as hereinafter defined). The minor and his or her parent or legal guardian may be required to sign other documents required by Tinker LLC. The parent or legal guardian must have the legal capacity to contract, both on his or her behalf and on behalf of the minor Participant.

For the avoidance of doubt, if it is found, at any time during or after the Contest Period, that any of the eligibility criteria herein are not met with respect to any Participant, such Participant may be disqualified from the Contest (as determined by Tinker LLC).

CONTEST TERMS:

  1. CONTEST: The Contest is designed to encourage eligible students, and their parents and legal guardians on their behalf, to use their creativity to educate their classmates and community on the importance of responsible WATER use.
  2. HOW TO ENTER: Contest begins at 12:01 a.m. PST on October 1, 2023 and ends at 11:59 p.m. PST on June 1, 2024.  Eligible persons, or their respective parents or legal guardians if a minor (collectively, “You,” or a “Participant”), may enter this Contest via the entry method described below.  You may enter only once per person.  All entries must be received by Tinker LLC no later than 5:00 p.m. PST on June 1, 2024.  Entries will only be accepted through the entry method described below. Proof of depositing entry in mail is not considered proof of entry, delivery or receipt.  No photocopied or mechanically reproduced, incomplete or duplicate entries will be accepted and the person submitting the same will be disqualified. All entries become the property of Tinker LLC and will not be returned. Any submission not meeting the criteria herein will be disqualified. Tinker LLC accepts no responsibility for submissions lost, delayed, damaged, defaced, or mislaid, howsoever caused, or any malfunction of the Contest website. Beginning on October 1, 2023, you may enter the Contest via the Internet by logging on to https://tinkerteach.org/23/fwtx/, and following the entry directions.  You will be requested to complete a one-page official entry form (the “Entry Form”) and a parental or legal guardian’s consent form (the “Consent Form”). Minors under the age of 13 must provide Tinker LLC with the written consent of such minor’s parent or legal guardian prior to entry. You may be required to provide some or all of the following information: your name, age, address, city, state, zip code, telephone number, and e-mail address. Entries made by any individual or any entity other than the named entrant, including (but not limited to) commercial Contest subscription notification and/or entering service sites are void. Entry Forms can only be submitted by Participants, or by parents or legal guardians, on behalf of minor Participants. Once the Entry Form is fully completed, it should be printed on a light colored 8.5”x11” sheet of paper and signed by the Participant or a parent/legal guardian on behalf of a minor Participant. The completed Consent Form can be submitted virtually via the online Entry Form at https://tinkerteach.org/23/fwtx/ or as a hard copy by mail to P.O. Box 177 Alamo, CA 94507.To submit an entry via the https://tinkerteach.org/23/fwtx/, please follow the instructions on the Contest site. Tinker LLC is not responsible for illegible or incorrectly submitted entries made via the [digital upload tool]. To submit an entry in hard-copy form, the entry form must be mailed in an envelope (packaged carefully so it won’t be damaged) with proper postage affixed, to the above mailing address. Entries received without a completed Entry Form or without a parent’s or legal guardian’s signature will be disqualified. Minors under the age of 13 will be required to provide a parental consent form or their parent or legal guardian’s email address prior to SUBMISSION. Tinker LLC will notify a parent or legal guardian through this email address when Tinker LLC receives a request to enter the Contest from a minor under the age of 13 without a parental consent form. Parent or legal guardian will have forty-eight (48) hours to confirm by email their consent to the minor’s Contest entry, including the collection of personally identifiable information of such minor, and to provide an executed parental consent form. If a parent or legal guardian fails to comply with the foregoing within forty-eight (48) hours of being notified by Tinker LLC, such minor’s entry and any information will be deleted.
  1. SUBMISSION CRITERIA: Each Submission shall be of a duration no longer than 4 minutes and focused on responsible WATER use. Additionally, each Submission must meet the following criteria: (a) it must not be derogatory, offensive, threatening, defamatory, disparaging, libelous or contain any content that is inappropriate, indecent, sexual, profane, tortuous, slanderous, discriminatory in any way, or that promotes hatred or harm against any group or person, or otherwise does not comply with the theme and spirit of the Contest; (b) it must not contain content, material or any element that is unlawful, or otherwise in violation of or contrary to all applicable federal, state, or local laws and regulation; (c) it must not contain any content, material or element that displays any third party advertising, slogan, logo, trademark or otherwise indicates a sponsorship or endorsement by a third party, commercial entity or that is not within the spirit of the Contest, as determined by Tinker LLC, in its sole discretion; (d) it must be original, unpublished work that does not contain, incorporate or otherwise use any content, material or element that is owned by a third party or entity; (e) it cannot contain any content, element, or material that violates a third party’s publicity, privacy or intellectual property rights, and (f) it does not include any disparaging remarks relating to the Tinker LLC or a third party.
  2. JUDGING: A total of up to 5 Contest finalists (“Finalists”) will be selected from the Submissions of each group on or about June 15, 2024, by judges selected by Tinker LLC, whose decisions are final and binding in all matters relating to this Contest. A contest prize as selected by Tinker LLC will be awarded by Tinker LLC to the winning Finalist selected by the judges (the “Winner(s)”), whose decisions are final and binding in all matters relating to this Contest.  The Winner(s) will be notified by Tinker LLC at the contact information set forth in such Finalist’s Entry Form.
  3. Prize conditions: No substitution for any Prize will be permitted.  Prizes must be accepted as awarded. A Prize is not transferable, exchangeable or assignable.  Failure to return any required documents may result in the Winner being disqualified and an alternate Winner selected.  If a Participant is found to be ineligible or declines acceptance of the Prize for any reason, an alternate Winner will be selected.
  4. PUBLICITY: By entering this Contest, each Participant hereby agrees and consents (except where [prohibited by law) to the reasonable use of by Tinker LLC, [and their respective subsidiaries, affiliates, subcontractors, successors and assigns (collectively, “Contest Parties”),] and hereby grants to Contest Parties a perpetual, irrevocable and royalty-free license to use, the Participant’s photograph, voice, likeness and/or image, hometown address, contents of the entry form, Submission, and the name and age of the Winners and Participants, without any further compensation for any future marketing, advertising, sales or other publicity or promotional activity carried out by any of the foregoing parties.
  5. ODDS OF WINNING: Odds of winning a Prize depend on the total number of eligible entries received for the Contest.
  6. CONDUCT OF PARTICIPATION: By entering the Contest, Participant affirms that he or she has read and agrees to abide by these Official Rules and the decisions of the judges.  Tinker LLC reserves the right to disqualify any Participant acting in violation of the Official Rules or found tampering with the entry process or with the operation of the Contest.  Tinker LLC’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision.  The Contest is governed by the laws of the state of California, without regard to any conflict of law rules; and, by entering; all Participants hereby submit to the jurisdiction and venue of the federal, state and local courts located in Contra Costa County, California.  ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE RELATED TO TINKER LLC OR THE CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, TINKER LLC RESERVES THE RIGHT TO SEEK DAMAGES FROM SUCH PARTY TO THE FULLEST EXTENT PERMITTED BY LAW. Tinker LLC reserves the right to disqualify any Participant from the Contest if, in Tinker LLC’s sole discretion, it reasonably believes that the Participant has attempted to undermine the legitimate operation of the Contest by providing false information, cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other entrants, Tinker LLC, or the judges.
  7. LIMITATIONS OF LIABILITY: CONTEST PARTIES AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, MANAGERS, MEMBERS, EMPLOYEES AND AGENTS, ARE NOT RESPONSIBLE FOR ANY INCORRECT OR INACCURATE ENTRY INFORMATION, THEFT, TAMPERING, DESTRUCTION, OR UNAUTHORIZED ACCESS TO, OR ALTERATION OF SUBMISSIONS; PRINTING OR OTHER ERRORS; AND ANY SUBMISSIONS WHICH ARE LATE, LOST, DELAYED, INCOMPLETE, MISDIRECTED, STOLEN, MUTILATED, ILLEGIBLE, POSTAGE DUE OR ANY COMBINATION THEREOF.  TINKER LLC RESERVES THE RIGHT TO MODIFY, SUSPEND OR TERMINATE THE CONTEST IN THE EVENT THAT IT BECOMES NECESSARY DUE TO CIRCUMSTANCES BEYOND TINKER LLC’S REASONABLE CONTROL. NOTWITHSTANDING ANYTHING CONTAINED TO THE CONTRARY HEREIN, THE MAXIMUM LIABILITY OF THE CONTEST PARTIES, REGARDLESS OF THE FORM OF ACTION, SHALL NOT EXCEED $500.
  8. RELEASE OF LIABILITY: By participating, each Participant agree to release, discharge, indemnify and hold harmless Contest Parties, and their respective officers, directors, managers, members, employees, representatives and agents from and against any claims, damages or other liabilities, whether made by the Participant, Winners, any entrants or any other third parties, related in any way to the operation of this Contest, as well as any other claims, damages or liability due to any injuries, damages or losses (whether alleged, threatened, or actual) to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any Prize, participation in any Contest-related activity or participation in this Contest.
  9. DISPUTES: Except where prohibited, by participating, each Participant further agrees that: (a) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any Prizes awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments, and awards shall be limited to actual out-of-pocket costs directly incurred by the Participant associated with entering the Contest, but in no event any other costs or expense, including attorney’s fees or costs; and (c) under no circumstances will any Winner or Participant be permitted to obtain any punitive, exemplary, indirect, incidental or consequential damages.
  10. WINNERS LIST: For an Official Winners List (available after July 1, 2024) or a copy of these Official Rules, send a self-addressed, stamped envelope to: “Tinker LLC Video Contest” – WINNERS – or – OFFICIAL RULES (please specify), c/o Tinker LLC, P.O. Box 177 Alamo, CA 94507.  All requests must be received by December 31, 2024.
  11. TINKER LLC’S INFORMATION: Tinker LLC, located at 425 Western Rd., Ste 106, Reno, NV 89506, 800-292-9054 and is the sponsor this Contest.
  12. PRIVACY:  Participants agree and acknowledge that personal data submitted with an entry, including name, age, mailing address, phone number, and email address may be collected, processed, stored and otherwise used by Contest Parties for the purposes of conducting and administering the Contest. All personal information that is collected from Participants, or parents and legal guardians on behalf of minor Participants is subject to Tinker LLC’s Privacy Policy, located at www.tinkerprograms.com. Individuals submitting personal information in connection with the Contest have the right to request access, review, rectification or deletion of any personal data held by Tinker LLC in connection with the Contest by writing to Tinker LLC at the following address P.O.
